The Danchenko trial slated for October is already heating up.
Forget the Sussmann trial, this trial of the suspected Russian spy who was the main source for the fake Steele Dossier is going to blow the lid off of everything.

The Clinton campaign was not only penetrated by Russian agents at the highest level…it was also paying a Russian agent who was the Primary Sub Source [PSS] of the fake Steele Dossier to invent allegations accusing Donald Trump, General Flynn, Carter Page and others of being…Russian agents!
And Durham will prove this in court.
Despite the fact Danchenko fled ahead of a FISA warrant as the FBI opened an espionage case against him in 2010, by at least 2015 he's back in the United States and working with Steele and Fusion GPS on the Steele Dossier.

But on Sept. 18 and 19, Sussmann did not tell the truth to a federal official.
There's simply no getting around this.
He did not tell the truth to Baker, and his subsequently telling the truth to others does not negate the fact he made a deceptive statement to a federal official.
In the interim between Sept 19 2016 and March 6, 2017, the FBI briefly opened up an investigation based on the AB hoax before closing it.
Even if Baker knew the truth that Sussmann was lying to him about being there on his own and not representing any clients [something we haven't seen any evidence for at this point], his statement to Baker is still a LIE.
Durham's Special Counsel's Office actually made this point in a prior filing. Even if an FBI official knows that the subject of an interview is telling him something that is false, this doesn't mean that person can't be charged with a crime. Of course they can charged for it.
Remember Igor Danchenko?
He's in the same fix Sussmann is in. He lied to the FBI about a key Steele Dossier source being Chuck Dolan.
The agents interviewing him already knew by the final interviews in 2017 that Dolan was a source. They knew Danchenko was lying to them. They let him talk.
Because they knew Danchenko was lying to them about Dolan's involvement, does that mean Danchenko couldn't be charged for making those false statement to them?
Think carefully before you answer that question.
